probation before judgment DUI Maryland attorney

Probation before judgment is a Maryland disposition in which the court, after a finding or plea of guilt, withholds entry of a judgment of conviction and places the defendant on probation instead. Whether it is available, and whether a court will grant it, depends on the charge, the record and the circumstances. Law Offices Of SRIS, P.C. handles these matters. Call (888) 437-7747.

Not a Dismissal and Not an Acquittal

The distinction matters and is widely misunderstood. There has still been a finding or an admission of guilt; what is withheld is the judgment of conviction. That has real consequences for how the matter is treated afterwards, including for licensing, employment and immigration questions, and those effects should be established before the disposition is agreed rather than assumed to be neutral.

It Is Discretionary

A court decides whether to grant it, and the request is made rather than claimed. What supports it is the same material that supports any favourable disposition: a clean record, preparation completed before the hearing rather than promised at it, evidence of steps taken since the arrest, and a presentation that gives the court something concrete to act on.

Eligibility Is Not Universal

Availability is limited by the charge and by history, including whether a similar disposition was granted before and how recently. Establishing eligibility at the outset avoids building a strategy around an outcome that was never open, which is a mistake that becomes apparent only at the hearing.

The Court Case and the MVA Proceeding Run Separately

A Maryland impaired driving arrest opens a criminal case in the District Court and an administrative licence proceeding before the Motor Vehicle Administration. They are decided by different bodies, under different standards, on different timetables. Neither outcome determines the other, and the administrative deadline runs from the stop rather than from any court date. Attending only to the court case is the most common and most avoidable failure in these matters.

Discovery Is Where the Case Is Built

Requesting discovery early matters because the material that supports or undermines a charge takes time to produce and review: the officer’s reports, any video from the vehicle or the station, the maintenance and calibration records for any testing instrument, and the certifications of those who operated it. A case assessed on the citation alone has been assessed on what is alleged, not on what can be proved.

Points and the Driving Record

A conviction is reported to the Motor Vehicle Administration, which applies its own consequences including points and, at defined thresholds, licence action, under rules separate from anything the court orders. Because those follow the conviction rather than the fine, resolving a matter by paying it accepts consequences never discussed in the courtroom.

Out-of-State and Commercial Drivers

Maryland reports dispositions to the licensing state, which applies its own rules, so the consequence at home can differ from what the Maryland outcome appears to carry. For a commercial driver the analysis changes again, because a conviction can affect the commercial licence through a separate framework. Both should be raised at the first conversation rather than discovered later.

Frequently Asked Questions

Is probation before judgment the same as a dismissal?

No. There has still been a finding or admission of guilt; the court withholds entry of the judgment of conviction. It has real consequences for licensing, employment and immigration questions that should be established before it is agreed.

Why are there two proceedings?

Because the criminal charge and the licence question are decided separately, the first by the District Court and the second by the Motor Vehicle Administration in an administrative hearing. Neither outcome determines the other.

Which court hears the case?

The District Court of Maryland for the county where the stop occurred. Venue follows the location of the stop rather than where the driver lives.

Should I just pay the citation?

Paying is a guilty plea, and the Motor Vehicle Administration then applies points and any licence consequence. Establish what the charge carries before treating payment as the simple option.

I am licensed in another state. What happens?

Maryland reports the disposition to the licensing state, which applies its own rules. It can change which resolution is preferable, so raise it early.

What should I bring to the first conversation?

The citation, your court date and District Court location, everything given to you at the stop including licence paperwork, and your driving record if you have obtained one.
