DUI lawyer Western Lower Shore
For a Western Lower Shore driver, what happens in court and what happens to the licence are answered by different bodies applying different rules. The District Court for the county hears the criminal charge. The Motor Vehicle Administration decides the licence question on its own track. Law Offices Of SRIS, P.C. handles Maryland impaired driving matters. Call (888) 437-7747.

ToggleWhat the Case Involves
Where no test result exists, the case rests on observation. Field sobriety testing assumes conditions a roadside stop often does not provide: level ground, adequate lighting, absence of passing traffic, and a subject without relevant physical limitations. Age, injury, footwear, weight, medical conditions and ordinary nerves all affect performance, and where the report does not record the conditions, that omission is itself worth examining.
Which Court Hears Your Case
The matter is returnable in the District Court for the county. Alongside it the Motor Vehicle Administration proceeding runs separately on its own timetable, and its deadline does not wait for the court date.
What to Do Before Your Court Date
Read every document given to you at the stop. The licence-related paperwork carries its own deadline, separate from the court date printed on the citation, and it is the item most often overlooked. Obtain your driving record so you know what the court and the prosecutor will see. Request discovery early, because chemical testing records and the officer’s reports take time to produce and to review. If you are licensed outside Maryland or hold a commercial licence, say so at the outset.
Frequently Asked Questions
What is probation before judgment?
A disposition available in Maryland in defined circumstances in which the court withholds entry of a judgment of conviction. Whether it is available in a particular case depends on the charge, the record and the court, and it should be discussed rather than assumed.
Do I have a right to a jury trial?
The District Court sits without a jury. A defendant may request a jury trial in the Circuit Court in defined circumstances, and whether that serves a particular case is a strategic question decided with the record in hand.
What should I bring to the first conversation?
The citation, your court date and the District Court location, everything given to you at the stop including any licence-related paperwork, and your driving record if you have obtained one.
